Ownership of the aurisreader.com website (hereinafter, the “Website”) belongs to Jésica Carballo Yanes, an independent professional operating under the trade name Auris Reader, in accordance with Article 10 of LSSI-CE.
II. General terms of use
Object
These General Terms of Use govern access to and use of the Website, including its contents, pages, features and published information (hereinafter, “Content”), as well as the online services offered through it (hereinafter, “Services”).
Auris Reader reserves the right to modify the presentation, configuration, Content and Services of the Website, and to interrupt or discontinue them temporarily or permanently, with reasonable prior notice where feasible, except for reasons of security, legal requirement or force majeure.
The User
Access, browsing and use of the Website grant the condition of user (hereinafter, “User”) and imply full acceptance of these Terms. Users are advised to read these Terms on each visit.
The User undertakes to make appropriate use of the Website, which includes:
- Using the Content and Services in accordance with the law, public order and these Terms, without infringing third-party rights.
- Providing truthful and lawful information in the Website’s forms, and notifying Auris Reader without undue delay of any misuse of credentials or unauthorised access.
The User declares to be at least 16 years old and to have sufficient legal capacity to be bound by these Terms.
The Website is offered globally. Auris Reader does not guarantee that all of the Content complies with the laws of every jurisdiction. Access from territories other than Spain is carried out at the User’s sole responsibility.
Mere access to the Website does not establish any commercial relationship between Auris Reader and the User. A contractual relationship arises only when the User creates an account, downloads the application or purchases a license, in accordance with the Terms of Service.
III. Access and browsing: exclusion of warranties and liability
Auris Reader does not warrant the continuous availability, uninterrupted operation or fitness for a particular purpose of the Website, its Content or Services. Auris Reader will make reasonable efforts to ensure correct operation but does not assume liability for interruptions, errors or technical failures beyond its control.
Auris Reader shall not be liable for losses, damages or harm arising from access to, browsing or use of the Website, including any caused by viruses, malicious software or other elements that may affect the User’s system. This exclusion does not apply to damages caused by wilful misconduct or gross negligence attributable to Auris Reader, nor to obligations whose exclusion is prohibited by mandatory law.
Liability is also excluded for damages arising from inappropriate use of the Website and for interruptions or deficiencies in telecommunications attributable to third parties.
IV. Linking policy
The Website may include links to third-party websites for the sole purpose of facilitating the User’s access to information available on the internet. Such links do not imply recommendation, approval or any relationship between Auris Reader and the owners of the linked sites.
Auris Reader does not control or warrant the availability, accuracy, truthfulness, legality or lawfulness of the content of third-party websites, and does not assume liability for damages arising from access to or use of them.
The establishment of a hyperlink from an external website to the Auris Reader Website is subject to the following conditions:
- Total or partial reproduction of the Website’s Content is prohibited without the express authorisation of Auris Reader.
- False, inaccurate or misleading statements about the Website or its Content are not permitted.
- The linking website shall not incorporate intellectual-property elements of Auris Reader without express authorisation.
- The hyperlink shall not imply any relationship between Auris Reader and the owner of the originating website, nor knowledge or acceptance by Auris Reader of its content or activities.
V. Intellectual and industrial property
Auris Reader, by itself or as an assignee, is the owner of all intellectual and industrial property rights in the Website and its Content, including, by way of example but without limitation: design, interfaces, Content, graphic elements, logos, navigation structure and underlying software.
These elements constitute works protected by Royal Legislative Decree 1/1996 of 12 April (Consolidated Text of the Intellectual Property Law) and applicable EU and international legislation.
The reproduction, distribution, public communication or transformation, in whole or in part, of the Content of the Website for commercial purposes is expressly prohibited without the prior written authorisation of Auris Reader.
The User may view, print, copy and store the Content of the Website exclusively for personal and private use, without commercial purposes and without removing, altering or manipulating any protection device or ownership mark embedded in it.
If the User or any third party considers that any Content on the Website infringes intellectual-property rights, they must report it to Auris Reader at info@aurisreader.com.

The processing of personal data of users of the Website is governed by the Privacy Policy, which describes data categories, purposes, processors and how to exercise rights under Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

VII. Applicable law and jurisdiction
These General Terms of Use are governed by current Spanish law.
Auris Reader reserves the right to pursue any civil or criminal action it considers appropriate in case of improper use of the Website or breach of these Terms.
For the resolution of any dispute arising from access to or use of the Website, the parties expressly submit to the courts of Santa Cruz de Tenerife, without prejudice to the mandatory jurisdictional rules applicable to consumers under Regulation (EU) 1215/2012 (Brussels I bis).
Severability
If any provision of these Terms is declared null or ineffective by a final judicial or administrative decision, such nullity shall not affect the validity and effectiveness of the remaining provisions, which shall remain in force.
